6. Payment Policies

Late Fee: A $15.00 late fee will be charged for payments not made within ten (10) days of the scheduled Payment Date.

- Returned Item Fee: An automatic debit/withdrawal that is returned or unsuccessful due to insufficient funds or other reasons will incur a returned item fee of $15.00.

- Monthly Payment Amounts: Members must make automatic monthly membership payments for the membership term.

- Monthly Statements: Payments will be made via automatic withdrawal from your bank account and appear on your bank statement. Written statements of your account balance can be provided only upon written request.

7. Cancellation Policies

- Member's Right to Cancel: You may cancel this contract by delivering or mailing a written notice to Apex Fitness LLC, 1214 Main Ave, Moorhead, MN 56560, within three business days of signing the contract.

- Additional Cancellation Rights: Month-to-month memberships require a minimum of two automatic payments before cancellation. Twelve-month contract memberships incur a $150 cancellation fee if canceled early.

8. Miscellaneous

Member’s Health Warranty: Members represent they are in good health and have no conditions preventing them from exercising.

- Rules and Regulations: Members agree to abide by all rules and schedules of the facility.

- Membership Key Fob: Members will be issued a key fob for facility access. Replacement fobs cost $5.

- Guests/Trial Users: All guests and trial members must purchase a day/week pass to use the facility.

- Transfer of Membership: Memberships are non-transferable.

- Valuables and Personal Property: Apex Fitness is not liable for the loss or theft of personal property.

- Children's Use: Members must be at least 15 years old. Children 15 to 17 can use the facility during staffed hours only.

- Dress Code: Proper athletic attire and footwear are required.

- Unauthorized Trainers: Use of non-Apex Fitness trainers in the facility is prohibited.

- Revocation of Membership: Apex Fitness reserves the right to revoke memberships at any time.
